Material Information

The fundamental basis of material information is that the average consumer should be given by Property Agents (estate and letting agents), the information they need to enable them to make an informed decision when they buy or rent a property.

There are three parts to Material Information. Part A was launched in early 2022 and Parts B & C at the end of 2023.

Part A requires agents and property portals to publish details during market listing on matters including council tax and charges, tenure type and asking price.

Part B covers information that should be covered for all properties, – such as the type of property, the building materials used, the number of rooms and information about utilities and parking.

Part C is information that only needs to be established if the property is affected by the issue – such as flood risks, restrictive covenants or building safety matters.

The information required for Part A and Part B should be readily available from the owner and property agent. However, Part C of the information isn’t readily available and this is where we can help.
Material Information for Part C includes the following;

• Building safety
• Restrictions and rights
• Flood and erosion risk
• Planning permission and proposals for development
• Property accessibility and adaptations
• Coalfield or mining areas

The guidance for Part C advises that the information only needs to be established if the property is affected by an issue. However, the information will still need to be looked into to see whether it does apply to a property. We can do this and advise you if the property is affected or not and if it is, provide those details.
